Why
are we supporting Mr J?
We are parents from the
school, neighbors, old friends, people from church, former
classmates, former coworkers, literally people all over the world,
along with family members, who know that it is undisputed that Mr J
has lived a respectable and productive life.
There were no independent witnesses
and the charges were preposterous. There is not one shred
of evidence that he ever did anything wrong, and tons of evidence
to support his good character.
On March 27, 2004, the San Diego Union Tribune printed the following letter to the editor:
Conviction of teacher a miscarriage of justice
As a 10-year veteran parent at Toler Elementary School, I can tell you that Thad Jesperson did not receive justice ("Former Clairemont teacher convicted of fondling student," News, March 18). I sat through the preliminary hearing and much of the trial; and knowing this great teacher, I cannot imagine that any reasonable person could convict him on the unbelievable and constantly changing testimony of eight children. As an involved parent volunteer, I can remember touching many children in many different ways. Once I helped a second-grade girl down from some playground equipment by creating a seat with my hands. I can only imagine how the prosecution would have distorted this. I am genuinely afraid for all teachers. Apparently, only a few children's stories stand between them and jail time. The only crime that has been committed here is that this dedicated teacher will not teach again. Did we learn anything from the Dale Akiki and McMartin witch hunts?
Our judicial system is supposed to be based on the assumption of innocence
until guilt is proven. These are the prerequisites of a fair trial in any alleged crime. Mr. Jesperson was not assumed innocent until proven
guilty. He was presumed guilty from the beginning of the trial.
Jurors do not realize the consequences of their rush to judgment. Despite having been counseled by the judge about innocence until proven guilty, and reasonable doubt, these jurors, without any physical evidence, reached a consensus of guilt in record time, based on
unsubstantiated theories and innuendo.
A prosecutor can only obtain a conviction without evidence or just cause when the judicial system bypasses due process.
Our founding fathers believed
that "Innocent until proven guilty"
is so important, they
wove it into the framework of our government. Mr. Jesperson's
Constitutional Right to a fair trial was violated in the worst way during this trial. This violation, not being presumed innocent until proven guilty beyond reasonable doubt, must be corrected or it will wrongfully cost him his life. As concerned citizens of these United States where Equal Justice Under Law for
Everyone is guaranteed to us by our Constitution, we would like to see the courts and prosecutors in this case follow this sacred law of the land. In America, a
person cannot be condemned to life in prison without any proof.
